Personal and Family Documents

Wills, affidavits, prenuptial and maintenance agreements and divorce settlements, prepared by lawyers online.

We draft the personal documents that protect you and your family in the UAE: last wills, affidavits, prenuptial agreements, monthly maintenance agreements and divorce settlement agreements. Prepared by our family and succession lawyers and delivered online in Arabic and English.

Overview

The documents that matter most to a family are usually written in a hurry, or not at all. A will that was never registered, a maintenance arrangement agreed by text message, a divorce settlement that leaves the family home unaddressed. In the UAE each of these documents has a legal form that the courts, the notary public and the wills registries will accept, and a form that they will not. Getting the form right is the difference between a document that works when it is needed and one that starts a dispute.

Khalifa Al Sada Advocates & Legal Consultants prepares personal and family documents online. Our family and succession lawyers draft them, explain what they mean, and guide you through the signature, notarisation or registration that each one requires.

Who we help

We prepare personal documents for:

  • Residents who need a will covering their UAE assets and the guardianship of their children
  • Couples preparing to marry who want a prenuptial agreement
  • Spouses agreeing the terms of a separation or divorce
  • Parents formalising child maintenance and visitation arrangements
  • Individuals who need an affidavit or a sworn declaration for a court, an embassy or an authority
  • Family members giving or receiving a power of attorney

These are private matters, and we handle them with the discretion they require.

What we do

We draft last wills and testaments in the form required by the DIFC Wills Service Centre, the Abu Dhabi Judicial Department or the Dubai Courts, covering property, accounts, shares, vehicles and the appointment of guardians and executors. We draft affidavits and sworn declarations in the form the receiving court or authority requires. We prepare prenuptial and postnuptial agreements that set out how property will be treated on divorce or death, within what UAE law allows, and monthly maintenance agreements between spouses or parents that can be recorded and enforced.

For couples separating we draft divorce settlement agreements covering the divorce itself, custody and visitation, child and spousal maintenance, the family home and the division of property, in a form that the personal status court or the Family Guidance Committee will record. We also prepare personal powers of attorney, guardianship declarations and consent letters for travel with children. Every document is delivered with a short explanation, in Arabic, English or both, and with clear instructions on where and how to sign, witness, notarise or register it. Where you prefer, our lawyers attend the registry or the notary with you.

Why Khalifa Al Sada

Our family and succession lawyers appear before the personal status courts and the wills registries every week, and they draft these documents the way those bodies expect to see them. A will or a settlement from us is prepared for registration, not just for signature.

The online service keeps standard documents affordable and fast, and our Dubai office is available whenever a matter needs a meeting. We work in Arabic and English, with Russian, Indian and Turkish desks.

Frequently asked questions

Is a will written online valid?

The will is drafted online, but it must be signed, witnessed and registered in the way the chosen registry requires. We arrange that step with you.

Are prenuptial agreements enforceable in the UAE?

They can be recognised, particularly under the civil personal status law for non-Muslims and for financial matters, but their effect depends on the law that applies to the marriage. We advise on what can and cannot be agreed.

Can a divorce settlement be agreed without going to court?

The terms can be agreed privately, but the divorce and the settlement must be recorded by the court or the Family Guidance Committee to be effective. We prepare the agreement in the form they accept.

Do you handle documents for use abroad?

Yes. We prepare affidavits and declarations for foreign courts and embassies and advise on the legalisation they require.
